1. Acceptance of Terms

By using My Life Habit (“the App”), you agree to these Terms of Service (“Terms”). If you disagree, do not use the App.

2. Service Description

My Life Habit is a habit tracking application.

Current Launch Phase: All features described below are currently fully accessible at no cost. Subscription tiers (Annual, Monthly, Lifetime) referenced elsewhere in these Terms will be introduced in a future update. Existing users will be notified before any changes affecting access.

Currently Available (Launch Phase)

During the current launch phase, every feature is fully accessible at no cost. This includes, without limitation:

• Unlimited habits, routines, and programs
• Three tracking styles — checkbox, quantity counter, timer
• 12-week heatmap and progress analytics
• Apple Health integration (opt-in, on-device)
• Friends — private, invite-only accountability
• Mood Check-In, pause, and skip without penalty
• No ads, no third-party tracking, no data sales
• English language support

Future Subscription Tiers

Subscription tiers (Annual, Monthly, Lifetime) are not currently active. When they are introduced in a future update, the specific feature set, pricing, trial terms (if any), data retention windows, and any other commercial terms will be disclosed before they take effect. Existing users will be notified in advance of any change that affects continued access to features they use today.

3. User Accounts

Account Requirements

• Account Creation: Account creation is optional
• Age Requirement: You must be at least 13 years old
• Parental Consent: Users under 18 must have parental consent
• Age Verification: We may request age verification at any time
• Account Security: You are responsible for account security
• Accurate Information: You must provide accurate information

Minor Users (13-17 years old)

• Parental Oversight: Parents/guardians should monitor app usage
• Limited Features: Some features may be restricted for minors
• Data Protection: Enhanced privacy protections for minor users

Account Security

• You are responsible for all account activity
• You must notify us of unauthorized access
• We are not liable for unauthorized account use

4. Subscription Terms

Current Status: Subscription tiers are not currently active. The terms in this section describe how subscriptions will operate once introduced in a future update. Until then, the App is fully accessible at no cost.

Premium Subscription (when introduced)

When subscription tiers are introduced in a future update, they will operate under the following structure. Specific pricing, tier features, and any trial-period terms will be disclosed in advance of activation.

• Subscriptions purchased through the Apple App Store
• Payment processed by Apple under your App Store account
• Auto-renewal unless cancelled before the renewal date
• Trial period, if offered, will be disclosed at the time of subscription launch

Subscription Management

• Cancellation: Cancel anytime through device settings
• Cancellation Process:
  • iOS: Settings → [Your Name] → Subscriptions → My Life Habit → Cancel
• Effective Date: Cancellation takes effect at the end of current billing period
• Grace Period: Premium features remain available until subscription expires
• No Partial Refunds: No refunds for unused portions of subscription period

Refund Policy

• Refund Processing: All refunds handled by App Store
• Refund Eligibility: Subject to platform refund policies
• Refund Timeline: Platform-dependent (typically 48-72 hours)
• Refund Contact: Contact platform support directly for refunds
• Our Role: We do not process refunds directly

Subscription Changes

• Price Changes: We may change subscription prices with 30 days notice
• Feature Changes: We may modify premium features with notice
• Grandfathering: Existing subscribers may retain current pricing for limited time
• Discontinuation: We may discontinue subscriptions with 90 days notice

5. Acceptable Use

Permitted Uses

• Personal habit tracking
• Legitimate business use
• Educational purposes

Prohibited Uses

• Violating any applicable laws
• Harassing or threatening others
• Attempting to hack or reverse engineer the App
• Using the App for commercial purposes without permission
• Sharing accounts with others
• Circumventing security measures
• Creating fake accounts
• Spamming or abusing the service
• Uploading malicious content
• Violating intellectual property rights

6. User Content and Data

Your Data

• You own your habit data
• You grant us a license to provide the service
• We do not claim ownership of your content

Our Rights

• We may use your data to provide the service
• We may use anonymized data to improve the App
• We may access your data for support purposes
• We may use your data to comply with legal requirements

6.1. Third-Party Services

Service Dependencies

Our App relies on the following third-party services:

• Appwrite: Backend services and data storage
• Apple Push Notification Service (APNs): Delivery of habit reminders and notifications
• Apple App Store: App distribution and, in the future, payment processing for subscriptions
• Apple HealthKit (optional): On-device integration for habit auto-completion. No HealthKit data is transmitted off-device.

Third-Party Liability

• We are not responsible for third-party service failures
• We are not liable for third-party data breaches
• We are not responsible for third-party policy changes
• Third-party services may change their terms without notice
• We recommend reviewing third-party privacy policies independently

Service Availability

• App functionality depends on third-party service availability
• We cannot guarantee 100% uptime due to third-party dependencies
• Service interruptions may occur due to third-party maintenance
• We will make reasonable efforts to minimize service disruptions

7. Intellectual Property

Our Rights

• App Ownership: The App and its content are owned by NextStar AI
• Legal Protection: Protected by copyright, trademark, patent, and trade secret laws
• All Rights Reserved: All intellectual property rights reserved
• Proprietary Technology: Our algorithms, code, and technology remain confidential
• Brand Protection: “My Life Habit” trademark and branding protected

Prohibited Activities

• Reverse Engineering: You may not reverse engineer, decompile, or disassemble the App
• Copying: You may not copy, modify, or create derivative works
• Redistribution: You may not redistribute, resell, or sublicense the App
• Competitive Use: You may not use the App to develop competing products
• Source Code: You may not access or attempt to access source code

Your Rights

• Data Ownership: You own your habit data and personal information
• Personal Use: You may use the App for personal, non-commercial purposes
• Limited License: We grant you a limited, non-exclusive license to use the App

Intellectual Property Violations

• DMCA Compliance: We comply with Digital Millennium Copyright Act
• Violation Reporting: Report IP violations to support@nextstarai.com
• Enforcement: We will take legal action against IP violations
• Termination: IP violations may result in immediate account termination

8. Disclaimers

Service Disclaimers

• The App is provided “as is” without warranties
• We do not guarantee 100% uptime
• We may suspend service for maintenance
• Premium features may be temporarily unavailable

Health Disclaimers

• The App is for informational purposes only
• Not a substitute for professional medical advice
• Consult healthcare providers for medical concerns
• We are not responsible for health outcomes

Data Disclaimers

• We implement backups but cannot guarantee against data loss
• You are responsible for backing up important data
• We are not liable for data loss due to technical issues

9. Limitation of Liability

Maximum Liability

• Our total liability shall not exceed $100 USD or the amount paid by you in the 12 months preceding the claim, whichever is greater
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for third-party actions or content
• We are not liable for data loss due to user error
• We are not liable for service interruptions beyond our control
• We are not liable for premium subscription issues handled by App Store

10. Indemnification

You agree to indemnify and hold harmless My Life Habit from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws
• Your misuse of the App
• Your fraudulent or illegal activities

11. Termination

Account Termination

• You may terminate your account anytime
• We may suspend or terminate accounts for violations
• Premium subscriptions must be cancelled through App Store
• Data deletion follows our Privacy Policy

Effect of Termination

• Your right to use the App ceases immediately
• Premium features become unavailable
• Data retention follows our Privacy Policy
• These Terms remain in effect for liability purposes

12. Modifications

16. Advertising and Data Retention

Advertising

• No Advertisements: My Life Habit does not display advertisements within the App.
• No Ad Networks: We do not integrate with third-party advertising networks.
• No Ad Tracking: We do not collect data about ad interactions, because no ads are served.

Data Retention Policy

Free Tier

• Habit Data: Retained for 1 month from last activity
• Account Data: Retained while account is active
• Inactive Accounts: Data automatically deleted after 1 month of inactivity

Subscription Tiers (when introduced)

Data-retention windows for subscription tiers will be specified at the time subscriptions are introduced. Existing users will be notified in advance of any change to retention applicable to their account.

Data Deletion

• User Request: Data deleted within 30 days of deletion request
• Account Termination: Data permanently deleted within 30 days
• Export Option: Users can export their data before deletion

17. Apple App Store Compliance

Apple App Store Requirements

• App Tracking Transparency: We comply with Apple's ATT framework for any tracking activities
• In-App Purchases: All premium subscriptions are processed through Apple's payment system
• App Store Guidelines: We adhere to all Apple App Store Review Guidelines

• Account Deletion: Users can delete their accounts directly within the app, or by emailing support@nextstarai.com
• Data Deletion: Account deletion is processed within 30 days, with complete data removal from all systems

Force Majeure

• We are not liable for delays or failures due to circumstances beyond our control
• Natural Disasters: Earthquakes, floods, hurricanes, fires, etc.
• Government Actions: Regulatory changes, sanctions, embargoes, etc.
• Technical Failures: Internet outages, power failures, cyber attacks, etc.
• Third-Party Failures: Service provider outages, payment processor failures, etc.
• Pandemic/Epidemic: Public health emergencies affecting operations
